SINGAPORE - The LGBT (lesbian, gay, bisexual and transgender) community here are "greatly shocked and disappointed" by the Court of Appeal's decision yesterday to reject the challenges to strike down Section 377A of the Penal Code Section 377A criminalises acts of "gross indecency" between men, without distinctions on whether it is in a public or private space, and imposes a maximum jail term of two years.

The appeals court rejected the argument of gay couple Gary Lim, 46 and Kenneth Chee, 38, as well as 51-year-old Tan Eng Hong that the provision infringes their rights to equality under Article 12 of the Constitution and violates their rights to life and personal liberty under Article 9.

In a statement released today, the LGBT community said that despite claims by the authorities that the law would not be enforced, its existence had a wide-ranging effect not only on Singapore's gay men, but also its lesbian, bisexual and transgender communities, adding that it also gives carte-blanche for discrimination and reinforces prejudice.

The statement read: "It is not an imposition for a segment to seek the same rights as the rest of society. To be viewed as equal in the eyes of the law, to feel safe at home, and to be protected against discrimination, mistreatment, even physical and emotional harm, is a right to which every Singaporean should be entitled, and not denied on the basis of whom they love."

The statement was jointly issued by a number of community groups, including LGBT counselling service Oogachaga, LGBT welfare network SAFE, gay rights movement Pink Dot and women's gay rights group Sayoni. The groups further added that the verdict represented a missed opportunity "to showcase Singapore as a truly accepting, open and inclusive society"."

I guessed it was a good news and bad news day yesterday for the LGBT in Singapore. Good news that Apple CEO Tim Cook came out as gay Thursday and said that fighting for equality is at the core of his personal and business ethos, and that he is proud to be gay. The bad news is that the Court of Appeal of Singapore rejected the decriminalization of same sex act between men in public or private setting.

Lessons for me are:

1. still back to the basic: can same sex marriage procreate naturally? IF not, same sex marriage is UNNATURAL. Period;

2. However, IF same sex marriage couples or partners WANT to have the marriage due to GENETIC make-up, it is totally understandable. At the same time, IF the union is a lifestyle choice, that one may want to be a bit more careful and try to discourage that;

3. still, that DOES NOT mean LGBT should be discriminated against. LGBT who are talent and productive like Tim Cook or anyone else MUST be allowed to work, live and contribute without harassment from fellow human beings who are straight. Sexual orientation does not decide if one has talent or not. Often time, hard work and smart application of learning, being flexible, willing to learn and practice, practice and practice make perfect!;

4. of course, as one of my close associates said: if we believe in evolution, there were species due to necessity actually evolved to a stage when same sex union CAN product the next generation! UNTIL and UNLESS human race EVOLVED to THAT STATE, having a law that clearly said: same sex acts between same sex human beings are not natural and not encourage.

5. lastly, it is very conceivable that THIS LAW WILL BE repealed eventually since the AUTHORITIES have 'said', not promised?, that it will NOT be enforced, as someone in the right position at the right time may jolly well decide: if it is NOT going to be enforced, why the heck have it there!".

The fundamental question still REMAIN then: can same sex marriage or union produce the next generation naturally?
